"The Company" and "we" means Twelve Percenter Limited trading as Stone of Destiny.
"The Buyer" and "you" means the Company, person or persons to whom goods are sold by the Company.
“Goods” means products and services supplied by The Company.
1. The Company’s Terms and Conditions are binding, unless any amendments are specifically agreed in writing between parties.
2. When samples are given, these are given on the understanding that exact resemblances cannot be guaranteed as all materials are subject to natural markings, veining and colour variations. Some cracks and vents are also common in the final product, and The Company will not be held responsible for these. The Buyer acknowledges that both natural and engineered stones can vary in colour, pattern, and texture. The actual stone delivered may differ from the sample shown. Offcut material is sold as seen. Natural and engineered stone is subject to variation in both shade and vein flow characteristics. The Buyer acknowledges that continuity of shade, book-match and vein flow can only be achieved if and when material has been purchased as consecutive slabs for this express purpose. The Buyer further acknowledges that additional stone ordered at a later date can be more costly and cannot be guaranteed to match the original stone.
3. Orders are accepted and templating and fixing dates are given in good faith, and are conditional upon our being able to secure the necessary labour and materials to carry out the order professionally. We do not synchronise our work with other trades and are not responsible in any way for their consecutive charges to you, howsoever this may arise.
4. It is essential that either The Buyer or a person authorised to make decisions on The Buyer's behalf is present on-site when our stonemasons visit to create templates. Every order is unique and our process includes a job checklist and signoff sheet that details everything discussed and agreed at the templating stage. If we are unable to create templates due to a lack of clear instructions or to obtain signoff on the agreed work, a re-visit charge will be payable.
5. Prior to templating, it is the Buyer’s responsibility to make sure all preparatory work is complete and all cabinets and sinks are in their final fixed positions. Cookers, hobs and taps are usually installed after the worktops but nevertheless must be available on site so that templates can be taken. If not, templating cannot be carried out and there will be a revisit charge.
6. After templating the Company will send out an order confirmation, outlining the final quote and details of the work to be carried out. If accepted by the Buyer, any balance due must be paid in full before we will begin fabrication. It is the Buyer’s responsibility not to change any of the specifications after templating. In the event that an order is cancelled after templates have been taken, the Company reserves the right to charge the Buyer for all work already done including templating, travel to and from site and preparatory work including the creation of CAD files.
7. We are specialists in manufacture and installation of our stone and porcelain products and for insurance purposes our fitters are unable to undertake any plumbing, carpentry, electrical or building works. It is the Buyer’s responsibility to arrange for any such tradesmen to be present during installation as necessary.
8. Goods delivered to the Buyer must be checked immediately and any damage/faults must be reported to the Company in writing within 24 hours of delivery. The onus is on the Buyer to check all products before fixing.
9. Unless expressly agreed in writing in advance, any unused or surplus material remains the property of the Company. After fabrication of your order any surplus material will either be disposed of or retained as stock at our discretion.
10. Any snagging lists you may have must be provided to the Company within 7 days of completion, in the absence of which full satisfaction will be assumed. Any alleged damage by our fitters to customers’ premises, furniture, surfaces etc., is to be pointed to our fitters immediately, and if not practical must be submitted in writing within three days of completion.
11. All countertops will be seamed or jointed as the slab size allows. The Company is solely responsible for seam placement in countertops, upstands and splashbacks. Fewer seams may require more material and expense.
12. Most materials are porous in nature and while these are resistant to staining and scratching can be subject to both. The Company makes no warranties implied or expressed as to stain resistance or imperviousness of the products to scratching, etching, staining or chipping. Marble and limestone installations in a kitchen environment are especially prone to staining and etching. The Buyer agrees that they will not hold The Company responsible for such damage that may be caused during the ordinary daily use of the Goods.
13. All slab work and countertops etc., will be polished on one side and sealed prior to installation. The Buyer acknowledges that the Company is supplying "surfacing" material only and releases the Company and installer from all liability for cracking or damage of material due to settling of the subsurface and/or improper substrate construction. Countertops have to be installed on sturdy level cabinets with a tolerance of 3mm per 3000mm span. The Company will not be responsible for re-fabrication of a top due to other people damaging the material. Most damage to stone occurs either during transportation and installation or by other trades who stand or work on the surface. Minor chipping of the material can occur during installation and is usually repairable on site. In the event chipping occurs, repair and/or the re-fabrication of any one piece is at the sole discretion of the Company.
14. Natural stones in slab or tile form are subject to a tolerance of a few mm in length and width. Calibrated material can be supplied at a premium subject to availability.
15. All conditions and warranties whatsoever as to the quality and fitness for any particular purpose for the goods supplied whether statutory or otherwise are hereby expressly excluded but every care will be taken to ensure goods supplied will conform to the Company’s standards or to specifications, within the limits of reasonable accuracy. The Company’s maximum liability in all cases shall be limited to the invoice value of the goods supplied. The Company accepts no liability for consequential loss or damage to property, which is attributed to the failure of the goods supplied whether due to accident, abuse, and incorrect technical assessment by the Company or its representatives or for any other reason whatsoever.
16. Retention of title of remains with the Company until full cleared payment for the agreed price of goods is received by the Company.
17. Clerical errors and omissions are subject to correction without notice.
